These Terms of Service ("Terms") govern access to and use of the Holix booking platform (the "Platform") operated by Holix Tecnologia ("Holix", "we", "us"). They form an agreement between Holix and the business or person who registers an account to run a booking site (the "Owner", "you").
By creating an account, accepting an invitation, or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
Holix provides software: a multi-tenant platform that lets an Owner publish listings, take bookings, and accept payments from guests. Holix is a technology provider and payment facilitator only.
Holix is not the merchant of record, is not the seller of any stay or service, and is not a party to the contract between an Owner and a guest. The booking is a direct agreement between the guest and the Owner. Holix is not responsible for listings, pricing, taxes, availability, the quality or legality of any stay, or disputes between an Owner and a guest.
Payments are processed by Stripe through Stripe Connect. Funds from a guest booking settle to the Owner’s connected Stripe account; Holix never takes custody of guest funds. The Owner is the merchant of record for every transaction on its booking site.
Holix charges a platform application fee on processed transactions, disclosed at onboarding. The Owner is responsible for its own pricing, refunds, chargebacks, taxes, and compliance with Stripe’s applicable terms.
The Owner is solely responsible for: the accuracy and legality of its listings and content; honoring its published cancellation and refund policies; collecting and remitting any applicable taxes; complying with all laws applicable to its business and location; and acting as the data controller for its guests’ personal data (see the Privacy Policy).
The Owner must not use the Platform for unlawful, deceptive, or prohibited activity, and must keep its account credentials secure.
You may not misuse the Platform, attempt to access it in unauthorized ways, interfere with its operation, or use it to violate the rights of others or any law. Holix may suspend or terminate access for violations.
To the maximum extent permitted by law, Holix provides the Platform "as is" and disclaims warranties not expressly stated. Holix is not liable for indirect, incidental, or consequential damages, or for losses arising from a booking, an Owner’s acts or omissions, a guest’s conduct, or third-party services (including Stripe).
Nothing here limits liability that cannot be limited by applicable law.
The Owner agrees to indemnify and hold Holix harmless from claims, damages, and expenses arising out of the Owner’s use of the Platform, its bookings, its content, or its breach of these Terms.
Either party may terminate the relationship as described at onboarding or in the account settings. On termination, the Owner remains responsible for obligations that arose before termination, including in-flight bookings and refunds.
Holix may update these Terms. Material changes will be surfaced in the Platform and may require renewed acceptance. The version and date above identify the current edition.
